1. Acceptance of Terms

By downloading, installing, or using Hindustan Awas Limited ("the App"), operated by Hindustan Awas Limited ("we", "us", "our"), you confirm that you are at least 18 years of age, have read and understood these Terms and Conditions ("Terms"), and agree to be legally bound by them. If you do not agree, you must not use the App.

2. App Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on your Android device for your legitimate real estate age business purposes.

This licence does not allow you to: copy, modify, reverse engineer, decompile, or distribute the App; remove proprietary notices; or use the App in any way that violates applicable law or these Terms.

3. Account Registration

To access the App's features, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date information during registration.
• Keep your login credentials confidential and not share them with anyone.
• Accept full responsibility for all activity conducted under your account.
• Notify us immediately at support@hindustanawas.com if you suspect unauthorised access.

4. User Content

You retain full ownership of all data you enter into the App, including lead details, property information, and deal records ("User Content"). By using the App, you grant Hindustan Awas Limited a limited, non-exclusive licence to store, process, and display your User Content solely for the purpose of providing the service to you.

You are solely responsible for ensuring that your User Content does not violate any third-party rights, privacy laws, or applicable regulations.

5. Intellectual Property

All intellectual property in the App — including the software code, design, graphics, logos, trademarks, and written content (excluding User Content) — is owned by or licensed to Hindustan Awas Limited. The Hindustan Awas Limited name and logo are trademarks of Hindustan Awas Limited.

You may not use our trademarks or reproduce any part of the App without prior written permission.

6. Prohibited Activities

When using the App, you agree NOT to:

• Use the App for any unlawful purpose or in violation of applicable Indian laws.
• Enter false, fraudulent, or misleading lead or property information.
• Attempt to gain unauthorised access to other users' accounts or our servers.
• Upload malware, viruses, or any malicious code.
• Scrape or extract data from the App using automated tools.
• Harass, impersonate, or misrepresent yourself or others.
• Attempt to reverse engineer, decompile, or extract the App's source code.
• Interfere with the performance or security of the App or its infrastructure.

7. Third-Party Services

The App integrates with third-party services including Google Maps for location selection, Firebase for cloud storage and analytics, and payment gateways for subscription billing. These services are governed by their own terms and privacy policies. We are not responsible for any third-party services.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM BUGS OR VIRUSES.

We do not verify or guarantee the accuracy of any lead, property, or deal information entered by users. All business decisions made using the App are your sole responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, HINDUSTAN AWAS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM:

• Your use of or inability to use the App.
• Any unauthorised access to your account or data.
• Any errors, bugs, or interruptions in the App.
• Business losses resulting from the use of App data or features.

Our total liability for any claim shall not exceed the subscription fees you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hindustan Awas Limited and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from: your use of the App; your User Content; your violation of these Terms; or your violation of any applicable law or third-party rights.

11. Termination

We may suspend or permanently terminate your access to the App at any time, without notice, if you breach these Terms, engage in fraudulent activity, or if we discontinue the service. Upon termination, you may request deletion of your data via our Delete Account page.

You may terminate your account at any time through the App settings or by submitting a deletion request.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India. We encourage resolution of disputes through amicable negotiation before formal proceedings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through an in-app notification and by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
